Terms of Use

By registering as a member of EE The Listening Post community, you agree to be bound by these terms of use, and it is your responsibility to read and understand them.

1. Essential information about EE’s The Listening Post

‘EE’ 'we' or 'us' means EE Limited. For details please see here: http://explore.ee.co.uk/privacy

Membership of The Listening Post is free. You may only have one membership of The Listening Post live at any one time and should not have a membership of more than one community at the same time. Membership is at EE’s invitation and EE may refuse your membership application and/or terminate your membership of The Listening Post at any time.

To join a community you must be 16 or over, live in the UK, have a personal email address and be a current customer of EE. If you no longer wish to receive emails from The Listening Post, please unsubscribe here, please note it sometimes takes up to 7 calendar days for the unsubscribe to come into effect.

To register, you must provide us with accurate, complete and up-to-date contact information, including name and email address. You are responsible for the information you provide to us. You must promptly update your account information online in the event of any changes to this information.

Upon registration, you will be asked to create a username and password. You must keep your username and password confidential at all times and use it only to access and use your account and not for any other purpose. You are the only authorised user of your account and, accordingly, you must not disclose your username and/or password to anyone else. Upon discovering any unauthorised use of your account or error in the operation of your username and/or password, you should contact us here immediately. Any breach of these terms and/or any use of your account by anyone to whom you disclose your username and/or password will be treated as if the breach or use had been carried out by you, and will not relieve you of your obligations to us.

2. Data Protection and Privacy

By registering to become a member of a community forum you consent to EE holding, storing, processing, analysing and using the information you submit for market research and service purposes only. Your name and e-mail address will not be disclosed to any third party (apart from EE’s data management agents) without your permission.

Personal information disclosed by you in the registration questionnaire (your name, e-mail address, postcode, year of birth etc.) will be stored securely, but by its nature will not be anonymous. If you do not wish EE to use data submitted by you in this way, please do not apply.

We will only deal with your personal information in accordance with the privacy policy which you can see here.

3. Code of Conduct

By using an online community you’re agreeing to these terms of use and as a member, you agree to:

  • provide information in the various market research activities in a truthful and constructive manner
  • to be entirely responsible for and keep secret any password used by you; you must change your password if you believe it is no longer secret
  • not to share any information about the topics we ask you about with anybody else
  • not to register as or on behalf of anyone else, impersonate anyone else, seek to take on a false identity or misrepresent yourself, your identity or your age
  • not to do, cause or permit anything to be done that may infringe, damage or interfere with any copyright, moral rights, performing rights, design rights, trade mark rights or other proprietary or intellectual property rights of EE, their respective licensors or any third party
  • to ensure that individuals featured in any audio/visual content you are posting are all 16 or over
  • not to post or otherwise make available content which is, in our view, abusive, offensive, defamatory, obscene, pornographic or of a sexual nature, illegal, threatening, intimidating, in breach of privacy, confidentiality or third party rights or otherwise unacceptable
  • not to post or otherwise make available content which, in our view, portrays unacceptable violence
  • not post or otherwise make available content containing financial information (such as account, credit or debit card details) or information which identifies an individual personally or is capable of identifying an individual personally (such as names, phone numbers, email addresses or postal addresses)
  • not do anything which will or might damage, interfere with, disrupt access to, overburden, interrupt or impair the functionality of the site, the materials available on the site or any software or hardware
  • not to behave in a way which is threatening, intimidating, harassing or bullying, offensive, abusive, defamatory, discriminatory or demeaning or to stalk or violate the rights of others including individuals' privacy rights

If you send an enquiry or request to the community manager which does not relate specifically to The Listening Post and would be better dealt with by another part of EE (such as the Customer Services department), we will acknowledge receipt of your message and provide you with a more appropriate email address to use or forward it on to someone who can help you.

4. General terms regarding The Listening Post prize draws

By using our communities you’re agreeing to these terms of use and as a member will be eligible for our prize draws. There is one prize draw for The Listening Post. The following terms and conditions apply to our prize draws:

  • our Prize draw is open to all members who take part in a research activity to which they have been invited to take part in via a specific e-mail. The prize draw period is the calendar month and any qualifying activity completed in this period will allow a single entry into the draw that will take place the following month. To qualify for any of these prize draws, members must be UK residents aged 16 or over, excluding employees of EE group companies and their agents; their families or any other person associated with it. Only one entry per person. No purchase is necessary
  • unless otherwise specified, the winner for each prize draw will be drawn from all eligible entries on the last day of each calendar month at random by an independent third party – their decision is final. No correspondence will be entered into
  • further discretionary monthly prizes may also be awarded for your contributions in the forums and surveys
  • by completing The Listening Post activities (e.g. surveys, quick polls) you agree to us contacting you about the prize draw
  • the winners will be notified by email on or before the 15th of the month following the prize draw
  • prizes will vary and will be detailed in the forum news posts
  • prizes are non-transferable and non-refundable. No cash alternative is available
  • if the winner fails to or is unable for any reason to accept the prize within two weeks of notification, EE reserves the right to award the prize to another entrant drawn at random
  • EE shall not be responsible for entries that are lost, corrupted or mis-transmitted. Proof of submission of your entry is not proof of receipt
  • EE reserves the right to award a prize of equal or greater value and, in exceptional circumstances, to vary, amend or withdraw this competition on reasonable notice
  • we accept no responsibility for damage, loss, liabilities, injury or disappointment incurred or suffered by the prize winner in entering the prize draw or accepting the prize, except in the case of death or personal injury caused by the acts or omissions of us or our employees
  • a list of prize winners from the prize draw will be made available monthly on the community pages
  • any queries relating to The Listening Post should be directed to nina@eelisteningpost.co.uk
  • the prize winner may be required to participate in some publicity
  • the promoter is EE Limited, Hatfield Business Park, Hertfordshire, AL10 9BW

6. Site information and downtime

This site may be unavailable occasionally for maintenance, updating or otherwise. Where this happens we apologise for any inconvenience caused.

7. Your Obligations

In using this site you agree to be responsible for any losses, expenses, costs or claim suffered by EE in respect of any User Content posted or shared on or through the site and any reckless or grossly negligent conduct when using the site. You’ll also be responsible to us for or a breach of any law or infringement of any third party’s rights.

8. Proprietary Rights

All text, graphics, audio, video or image files, content, software, applications and information displayed on or available from this site, and all copyright, trade mark rights, design rights and other intellectual property rights in them (together, the "Proprietary Content") are the property of EE The Listening Post, other EE companies, our users, suppliers or licensors. This includes, without limitation, the organisation and lay-out of the site and the underlying software that is owned by us, other EE companies, our users, suppliers or licensors. By using the site you're agreeing that Proprietary Content is available for personal use only and that you will not copy, reproduce, publish, distribute or dispose of in any way any Proprietary Content (other than your User Content which you have posted and for which you have the appropriate rights and permissions). Neither the name EE, nor any other EE company name, trade mark, logo or design may be used or copied in any manner.

You agree that any intellectual property, including but not limited to, copyright and related rights, inventions, and confidential information (including know how) arising out of your involvement or contribution to our community forums shall belong to EE. You acknowledge that EE shall be free to use any such intellectual property for any purpose, including but not limited to, for the purpose of the further development of, commercialisation and exploitation of the same.

9. Liability

It is important to note that using the internet does have its dangers. Our aim is to ensure a fast, reliable and secure service and to protect your personal information. However we cannot take responsibility for:

  • any breach of security on our forums
  • any damage, loss or corruption of any User Content, data, information or material
  • any viruses or other malicious programs that may infect your computer equipment or other property
  • any breach of security by hackers in relation to our forums and your profile
  • any defects that may exist or for any costs, loss of profits, loss of data or consequential losses arising from your use of, or inability to use or access or a failure, suspension or withdrawal of all or part of the community forums at any time

10. Suspension, Variation and Termination

We may suspend or vary the whole or any part of the community forums for any reason, at any time at our sole discretion without liability to you.

We reserve the right to vary these Terms of Use from time to time, such variations becoming effective immediately upon posting of the varied Terms of Use on the community website. By continuing to use the community forum you will be deemed to accept such variation.

11. Other terms — a final word from our lawyers

These Terms of Use and the Privacy Policy constitute the entire agreement between you, the user, and EE in relation to your use of the site.

12. Law and Jurisdiction

These Terms and Conditions and any dispute in relation to them is governed by English law and we reserve the right to bring proceedings in the courts in any location, the English courts or whichever forum we feel is appropriate.

If any provision or part of these Terms of Use is or becomes illegal, invalid or unenforceable, the legality, validity and enforceability of all of the other provisions and parts of these Terms and Conditions will not be impaired.

No failure or delay by EE in exercising or enforcing any right, power or remedy which arises under these Terms and Conditions shall operate as a waiver of that or any other right, power or remedy. No waiver by EE shall be effective unless in writing and signed by an authorised representative of EE.
